VPS BUNDLE PROGRAM AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ENROLLING IN THE VPS BUNDLE PROGRAM.

THIS VPS BUNDLE PROGRAM AGREEMENT (“AGREEMENT”) IS A LEGAL CONTRACT BETWEEN YOU, AS EITHER AN INDIVIDUAL OR AN ENTITY, AND CLOUD LINUX SOFTWARE, INC. (“CLOUDLINUX”), GOVERNING YOUR PARTICIPATION IN THE VPS BUNDLE PROGRAM DESCRIBED HEREIN (THE “PROGRAM”).

REFERENCES TO “YOU” OR “PARTNER” HEREIN REFER TO BOTH YOU, THE INDIVIDUAL ACCEPTING THIS AGREEMENT, AND THE ENTITY ON WHOSE BEHALF YOU ARE ACCEPTING THIS AGREEMENT.

BY CHECKING THE BOX, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE PROGRAM.

THIS AGREEMENT IS SUPPLEMENTAL TO, AND DOES NOT REPLACE, THE CLOUDLINUX AND IMUNIFY LICENSE AGREEMENTS AND TERMS OF USE PREVIOUSLY ACCEPTED BY YOU. IN THE EVENT OF A CONFLICT BETWEEN THIS AGREEMENT AND LICENSE AGREEMENTS, THE TERMS OF THIS AGREEMENT SHALL GOVERN SOLELY WITH RESPECT TO YOUR PARTICIPATION IN THE PROGRAM.

1. Program Overview

CloudLinux will provide special bundled pricing for CloudLinux OS and Imunify360 (the “Licensed Products”) for use in Partner’s VPS plans, subject to the terms herein.

2. Participation Requirements

2.1 Partner must offer VPS hosting plans with the Licensed Products pre-installed and enabled by default.

2.2 Partner must represent the Licensed Products on its website as an “included” or “free” feature within the relevant VPS plans. 

2.3 The Partner must prominently display the Licensed Products, along with the CloudLinux and Imunify360 logos, as part of the VPS package on the main VPS bundle webpage. The inclusion of the Licensed Products must be visible without requiring additional clicks (e.g., not hidden under subpages, tabs, footnotes, or separate categories). The logos must be displayed in accordance with the CloudLinux Logo and Trademark Usage Guidelines. CloudLinux reserves the right to review and approve the Partner’s presentation of the Licensed Products and may request adjustments to ensure proper visibility and customer awareness.

2.4 Partner agrees to actively promote the bundled VPS plans using marketing materials provided by CloudLinux, including through blog posts, social media platforms, email communications, and other marketing campaigns.

2.5 Partner must establish a new CLN account to manage licenses issued under this Program. Special pricing will apply only to licenses managed through this new account.

3. Use Restrictions

3.1 Only new servers with new IPs may be included in the Program.

3.2 Existing servers with active CloudLinux OS or Imunify360 licenses are not eligible.

3.3 Dedicated servers are not eligible for participation in the Program by default. However, CloudLinux may, at its sole discretion, approve limited exceptions in writing for:

3.3.1 One-time migration of existing VPS accounts that do not currently have the Licensed Products; and/or

3.3.2 Use on dedicated servers, where such inclusion has been expressly authorized by CloudLinux.

3.4. Partner is expressly prohibited from transferring or reassigning any existing licenses/servers currently managed under other CLN accounts into the CLN account established for the VPS Bundle Program.

4. License Terms

4.1 Licenses are granted only for use within the scope of this Program.

4.2 Partner may not transfer, sublicense, or use the licenses outside the permitted use cases.

4.3 CloudLinux reserves the right to audit Partner’s use and revoke licenses in case of non-compliance.

5. Termination

CloudLinux may suspend or terminate Program participation at any time, with or without cause, upon written notice.
